The USERRA Act
The Uniformed Services Employment and Reemployment Rights Act (USERRA) was passed in 1994 in to help protect the civilian jobs held by members of the US military who have been called in to active duty. It protects the employment of American soldiers who are bravely protecting their country abroad, freeing them from the worry that they’ll come home from their tour of service to find that their jobs have been given away.

The Provisions of the USERRA
The USERRA applies to all servicemen and women who are not full-time military personnel and have had to temporarily leave their jobs to serve. Their employers will have to bring them back with:
- The same seniority
- The same status
- The same pay
In essence, the employer has to keep the position open for the serviceman or woman as though they had never left. The employer must also provide retraining or other services if the employee requires them for employment. If the employee cannot qualify for the same job, alternative employment must be offered.
