Do employers have to offer meal breaks?
In some states, such as California, employers are legally required to give employees breaks for lunch or dinner. Texas is not one of them. In fact, there are no Texas laws that address meal breaks one way or the other. There are, however, two federal laws concerning breaks:
- Any break under 20 minutes must be paid.
- An employee who needs to use the bathroom must be granted permission.
